Terms and conditions

Last updated October 21, 2026.

These terms apply when you use this website or buy from us. By using the site or placing an order, you agree to them. If you do not agree, please do not use the site or place an order.

Who we are

This website and Odden are operated by CaskStack, LLC ("Odden", "we", "us"), a company based in the United States. You can reach us at support@odden.io.

What these terms cover

  • The open-source packages (Odden Core, Sales, the Filament admin and the mail builder) are free and licensed under the MIT license. Early releases of Marketing and Service, up to version 0.9, were also published under the MIT license, and that license stays with them. Version 0.9 is frozen: it receives no new features, fixes or security updates. These terms do not change any MIT license already granted, and you do not need to accept anything to use MIT-licensed software.
  • Odden Marketing and Odden Service are paid add-ons, each licensed per production site, and both include the AI features described below. They are also governed by the Odden Paid Add-ons License Agreement, which comes with the software.
  • Odden Cloud is the hosted version of Odden: workspaces where you and your team keep your contacts, deals, tickets and campaigns. You can try it free for 30 days and then subscribe. These terms apply to it, together with the sections below on Odden Cloud subscriptions, accounts and workspaces, exporting and deleting your data, hosted email, and our data processing addendum, which applies to the information you keep in a workspace.

Orders and payment

Orders are sold by CaskStack, LLC. Payments are taken by Stripe, our payment processor, on its secure payment page, so your card details go to Stripe and never reach us. We provide customer service and handle returns: write to support@odden.io.

Prices are shown in US dollars on our pricing page. Where we are required to collect a tax, such as sales tax or VAT, it is calculated at checkout according to where you are and added to the price before you pay. Stripe's own terms and privacy notice apply to the payment.

Add-on licenses

  • One license is for one live (production) site. Local, development and staging copies are free. Using one license on several live sites is not allowed.
  • A license is for updates. It covers every version released while the license is paid, and for 30 days after. If a payment lapses, the software you already have keeps working and you can keep using it, but you will not get newer versions until you renew. We do not switch features off.
  • Licenses renew automatically. A yearly license renews each year, and an agency license each month, at the renewal price shown when you bought it, charged to the payment method you used, until you cancel. You can cancel at any time from the link in your receipt and invoice emails (Stripe's customer portal), or by contacting us. Cancelling stops future renewals and does not refund the current period, except as our refund policy says.
  • Your license key is delivered by email when your payment is confirmed. Keep it secret: it is the password to download the software, and you are responsible for what is done with it. You can make a new key at any time from your license dashboard.

Using the software and the site

You agree not to use the site or the software to break the law, commit fraud or send spam, infringe anyone else's rights, or interfere with the security or operation of the site or of our servers. You may not copy, resell or share the paid software or your license key except as your license allows.

AI features

The AI features that come with Odden Marketing and Odden Service run on your own AI provider account and key (currently Anthropic). When you use them, the data described in the product's documentation is sent to that provider under your agreement with them, not with us. You are responsible for how you use the AI features, for any limits and costs your provider sets, and for checking what they produce before you rely on it or send it to anyone. AI output can be wrong, incomplete or unsuitable. We do not guarantee its accuracy. You must not use the AI features to create unlawful, harmful or deceptive content, and you are responsible for the content you send to your provider. The software and its documentation remain ours (or our licensors'), and what you create with them remains yours.

Hosted email (Odden Cloud)

Hosted email lets a workspace send email from its own domain through Odden's account with our email provider (currently Amazon Simple Email Service). Using it means you also agree to this section. You can instead connect your own email server, to which this section does not apply.

  • Your domain. You may only send from a domain you own or control, and you must verify it by publishing the DNS records we show you. We may refuse or remove a domain that is not yours, that belongs to a free-mail or disposable provider, or that we reasonably believe is being used to impersonate someone else. A domain belongs to one workspace at a time, and one that is added and never verified is released after a short time.
  • Who you may email. Send only to people who have agreed to hear from you or who you otherwise have a lawful right to contact, and give every marketing email a working unsubscribe link and your physical address. You are responsible for your lists and your content, and for following the laws that apply to them (such as CAN-SPAM, GDPR and CASL). You may not send unlawful, deceptive, sexual, hateful, abusive or harassing content, malware or phishing.
  • Our email provider's rules. Our provider's terms and acceptable use policy apply to what goes out through our account, and we pass them on to you. We may need to act on a complaint or a notice from the provider at once.
  • Allowance and fair use. Hosted email includes a monthly allowance, which depends on your plan and the contacts your workspace holds (as described on our pricing page). We tell you as you near it. If a workspace sends far more than its allowance, hosted sending stops until the next month. It is meant for ordinary business email, not for bulk or resale, and for more you can connect your own email server.
  • Protecting deliverability. Everyone who uses hosted email shares our reputation with email providers, so we watch bounces and spam complaints for every workspace. If they rise too high, we warn you, and if they keep rising we pause hosted sending for the workspace. We may also pause sending at once if we reasonably believe there is abuse, a security risk or a complaint we must act on. We lift a pause once the problem is dealt with, and we tell you when we pause. While sending is paused, emails are not sent.
  • Addresses that bounce or complain. We suppress an address after it hard-bounces or someone reports your email as spam, so that you stop sending to it. We keep records of sends, bounces and complaints to run this, as our privacy policy describes.
  • No guarantee of delivery. We cannot promise that an email will reach an inbox or avoid a spam folder, because that depends on the recipient's provider and on your content and lists.

Odden Cloud accounts and workspaces

Accounts. You need an account to use Odden Cloud. Give us accurate details, keep your password and two-factor device secure, and do not share a login: everyone who uses a workspace needs their own. You are responsible for what is done with your account and for the people you add to a workspace and the roles you give them.

Workspaces and owners. A workspace belongs to the customer that created it. Its owners control it: they can add and remove members, turn features on, export the workspace's data and delete the workspace. If you add someone as an owner, you trust them with all of this.

Your data. What you keep in a workspace is yours. You give us the right to host and process it to provide Odden Cloud, as our data processing addendum describes. You are responsible for it: that you may put it there, that the people it is about have been told what is needed, and that you respect their rights. We do not use it for our own purposes.

What you may not store. Do not store payment card numbers, government identity numbers, health information or other special categories of personal data, or children's data in a workspace.

Acceptable use. You agree not to use Odden Cloud to break the law, send spam, harass or deceive people, publish unlawful, hateful, sexual or abusive content, spread malware, probe or attack our systems or other customers' workspaces, or use more than ordinary resources in a way that affects other customers. Public pages you publish (forms, help centre, landing pages) are yours and you are responsible for them.

Support access. To help you, or to investigate abuse or a security problem, an administrator of ours may open your workspace in a recorded, time-limited support session. It is read-only unless you have allowed changes, your owners are emailed when one starts, and every session is listed in the workspace under Support access.

Availability. We work to keep Odden Cloud running but do not guarantee it will be uninterrupted or error-free; see "No guarantee, and limits on what we owe".

Odden Cloud subscriptions

  • Free trial. A new workspace has a 30-day trial that starts when you confirm your email address, and no payment card is needed. During the trial a workspace cannot send campaigns or other email to its contact lists; it can send a limited number of team and system messages each day. We may lift this for a workspace we have checked.
  • Plans and prices. Odden Cloud is sold as Starter, Growth or Suite, monthly or yearly, per workspace, with an optional capacity add-on for more contacts. Enterprise is arranged with us. The price is shown at checkout in US dollars, and any tax that applies is added at checkout. Each plan includes the packages and the number of contacts shown on our pricing page. A workspace at its contact limit cannot add contacts until it has room or more capacity, and nothing is deleted.
  • Renewal. A subscription renews automatically each month or year at the price you agreed, charged through Stripe to the payment method you used, until you cancel. Owners can cancel from the Billing page in the workspace. A cancelled subscription stays active until the end of the period you paid for.
  • Price changes. If we change the price of a plan, the new price applies from your next renewal, after at least 30 days' email notice to the workspace owners.
  • Changing plan. Moving to a higher plan takes effect at once and is charged pro rata for the rest of the period. Moving to a lower plan takes effect at your next renewal.
  • If a payment fails or a trial ends unpaid. We tell the owners and Stripe retries the payment on our behalf, for up to two weeks; if every retry fails, the subscription is cancelled. A workspace with a payment that stays overdue becomes read-only 7 days after it fell due, and a workspace whose trial ends without a subscription becomes read-only at once. A read-only workspace can still be opened and exported. If it is not paid, its public forms, API writes and new contacts stop 14 days later, and 30 days after it became read-only we schedule its deletion, with notices and the grace period described below. Paying restores it.
  • Cancelled or disputed subscriptions. When a subscription ends, because you cancel it and the period you paid for runs out, every retry of a failed payment fails, or a payment is disputed with your bank, the workspace becomes read-only: you can still open it and export your data. If it is not paid, we schedule its deletion 30 days later, as described above.
  • Refunds. See our refund policy.

Exporting and deleting your data

Export. A workspace owner can export everything in the workspace at any time from Workspace, Export your data. We prepare it in the background and keep the file for 7 days, then delete it. It holds personal data about your contacts and users: keep it safe.

Deleting a workspace. A workspace owner can delete it from Workspace, Delete this workspace. It is switched off at once (nobody can open it and its pages, API, email and automations stop) and we keep it for 30 days, so an accidental deletion can be undone. During those 30 days any owner can cancel the deletion from their account page, and owners can still export. After 30 days we delete the workspace and its data permanently and it cannot be recovered. Our backups are overwritten within 7 days after that. The workspace's address is not given to anyone else for 90 days.

Closing your account. You can close your own account from your account page. We switch it off at once and erase it after 30 days unless you reopen it using the link we email you. You cannot close it while you belong to a workspace, you are an administrator, or you have a license that is still paid up; first leave or delete the workspace, or let the license run out or contact us. We keep a record that a purchase happened, without your name or email address, as tax law requires.

Ownership

We own the paid software, this website and everything in them, apart from the open-source packages, which belong to their authors under the MIT license. Buying a license gives you the right to use the software under its license agreement. It does not transfer ownership.

No guarantee, and limits on what we owe

We work hard on the software and the site, but we do not promise that they will be uninterrupted or free of errors. To the fullest extent the law allows, the software and the site are provided "as is", and we are not liable for lost profits, lost data or indirect or consequential loss. Our total liability for anything arising from a purchase is limited to the amount you paid us for it in the 12 months before the claim. Nothing in these terms limits any right you have by law that cannot be limited.

Suspension and ending

We may suspend or end your access, and revoke a license key, if you materially breach these terms or the license agreement and do not fix it within 30 days of our telling you, or immediately if we reasonably believe there is fraud, non-payment or a risk to security. Revoking a key stops downloads and updates; it does not switch off a site that is already running.

We may also suspend an Odden Cloud workspace at once, without notice, if we reasonably believe it is being used to send spam or other abuse, to attack others or our systems, or in a way that puts other customers or the service at risk, or when an email provider or the law requires it. We tell the owners why and lift the suspension when the problem is dealt with. A suspended workspace is switched off like one scheduled for deletion, but its data is kept and nothing is deleted because of the suspension. If your Odden Cloud agreement ends we treat it as a request to delete the workspace, as described above.

Changes

We may update these terms. The date at the top shows when they last changed. A change applies to purchases made after it, and to renewals only from your next renewal. Changes to our data processing addendum and sub-processor list follow the process in those documents (30 days' notice to workspace owners).

Governing law

These terms are governed by the laws of the State of California, and any dispute will be heard in the state or federal courts located in California. If you are a consumer, this does not take away any rights you have under the mandatory laws of the place where you live.
